Nintendo Gamecube and Wii Controllers in Trouble

spacer_white.gif

gamecube wavebirdNintendo is the latest conquest of a small Texan company. Anascape Ltd. Has successfully filed a patent infringement against Sony and Microsoft. Sony licensed the patent in2004 while Microsoft settled in May of this year.

Nintendo challenged the ruling but the court sided with Anascape. This ruling makes it illegal for Nintendo to sell its Wii Classic Controller, GameCube WaveBird, and the regular GameCube controller. This ban is still on hold while Nintendo appeals the ruling to the U.S. Court of Appeals.

Nintendo spokesman Charlie Scibetta has this to say about the case:

“Nintendo was already planning to appeal this case to the Federal Circuit court. The recent ruling by the trial court does not impact that decision.”

According to reports, the patent in question is Anascape’s design on certain configuration of the remote to control six types of motions at the same time.

Not included in the ban are the Wii remote and the nunchuk. It is found out that these controllers don’t violate the patent in question. This lawsuit will not affect Wii’s domination of the market at all.

I like the idea of Anascape being a giant killer but I don’t think Nintendo has violated any patents with any of their controllers. Though I haven’t seen Anascape’s patent yet. What do you think? Does Anascape have a valid case or not?

No, a controller to control six types of movement at once sounds vague enough to be anything, if I were the judge I’d laugh at this case and not even take it up.

        yup it’s vague indeed.
i don’t know why the judge made the judgment he made on this case.
